GENERALS TERMS AND CONDITIONS OF SALE

Preamble : These General Terms and Conditions of Sale (GTC) apply to all sales concluded on the website www.tapir-equipements.fr between the company TAPIR Equipements and any buyer, whether a consumer (natural person acting for non-professional purposes) or a professional. They are governed by the French Consumer Code, the French Civil Code, and the French Commercial Code.
Article 1 – Purpose
These General Terms and Conditions of Sale (GTC) detail the rights and obligations of TAPIR Equipements and its customers in connection with the sale of goods or services via the website www.tapir-equipements.fr. Any order placed on the website implies the buyer's full and unreserved acceptance of these GTC. The GTC are accessible at any time on the website and shall prevail over any other document.
Article 2 – Price
The prices of goods are those in effect on the date the order is placed. They are expressed in euros and shown inclusive of all taxes (VAT) on the website, in accordance with Article L.112-1 of the French Consumer Code. Delivery charges are shown separately before order confirmation.
TAPIR Equipements reserves the right to change its prices at any time. Goods ordered are invoiced at the prices displayed at the time the order is confirmed.
Article 3 – discounts and rebates
TAPIR Equipements reserves the right to offer discounts, rebates, and promotions at its discretion. These offers are valid only under the conditions and during the periods specified and cannot be combined unless expressly stated otherwise.
Article 4 – Discount
No discount will be given for early payment.
Article 5 – Payment methods
Orders can be paid for using one of the following methods:
•Credit Card ;
•Bank wiring ;
•PayPal.
For all orders totaling €2,000 or less (excluding VAT), full payment is required upon order confirmation.
For orders exceeding €2,000 (excluding VAT), the buyer may pay a 10% deposit of the total amount (including VAT) upon placing the order, with the balance due upon delivery of the goods.
Payment security : Online payments are secure. TAPIR Equipements does not store any banking information.
Article 6 – Late paymet
In the event of total or partial non-payment by the agreed due date, the buyer will owe TAPIR Equipements a late payment penalty equal to three times the legal interest rate in effect on the date of delivery. This penalty is calculated on the outstanding amount due, including VAT, and accrues automatically from the due date, without prior notice.
The legal interest rate is revised every six months in accordance with Ordinance No. 2014-947 of August 20, 2014.
In addition to late payment interest, any sum not paid by its due date will automatically incur a fixed recovery fee of €40 (Article L.441-6, paragraph 12 and D.441-5 of the French Commercial Code). This fee applies to transactions between professionals. For consumers, payment is required upon ordering, in accordance with Article 5.
Article 7 – Termination cause
If, within fifteen days of the implementation of Article 6, the buyer has not paid the outstanding amounts, the sale will be automatically cancelled. This cancellation may entitle TAPIR Equipements to claim damages.
Article 8 – Clause de réserve de propriété
TAPIR Equipements retains ownership of the goods sold until full payment of the price, including principal and any additional charges. In the event of receivership or liquidation of the buyer, TAPIR Equipements reserves the right to reclaim, within the framework of the insolvency proceedings, the goods sold but not fully paid for.
Article 9 – Livraison
Delivery is made:
• Either by direct delivery of the goods to the buyer;
• Or to the address indicated by the buyer when placing their order.
Delivery time : The delivery time indicated at the time of ordering is an estimate. In accordance with Article L.216-1 of the French Consumer Code, for consumer orders, delivery must take place no later than 30 days after the conclusion of the contract, unless otherwise agreed. If this deadline is exceeded, the consumer may cancel their order and obtain a full refund of the sums paid within 14 days.
Exceptions : In the very specific cases of items requiring manufacturing and whose manufacturing time is indicated "Manufacturing within 30 days", this legal delivery period of no more than 30 days may not be respected.
Shipping risks : The buyer assumes the risk of loss or damage during shipping upon delivery of the package to the carrier. For consumers, in accordance with Article L.216-4 of the French Consumer Code, the risk is transferred upon actual delivery.
In the event of missing or damaged goods during shipping, the buyer must note all necessary reservations on the delivery slip upon receipt and confirm them in writing within 5 days by registered letter with acknowledgment of receipt.
If the delivery address is incorrect or the package is not collected, resulting in its return to the sender, the return shipping costs will be charged to the buyer. A new shipment will be invoiced at the current rate.
Article 10 – Force majeure
TAPIR Equipements cannot be held liable if the non-performance or delay in the performance of its obligations results from a case of force majeure within the meaning of Article 1218 of the Civil Code (replaces the former Article 1148), that is to say any external, unforeseeable and irresistible event, such as natural disaster, epidemic, general strike, network failure, etc.
Article 11 – Consumers rights
Legal period : In accordance with Articles L.221-18 & s. of the Consumer Code, any consumer (natural person acting for non-professional purposes) has a period of 14 calendar days to exercise their right of withdrawal from the day after receipt of the order, without having to justify a reason or bear any penalty, with the exception of return costs.
Please note : This 14-day period replaces the previously mentioned 15-day period, in accordance with European Directive 2011/83/EU transposed into French law. If this period expires on a Saturday, Sunday, or public holiday, it is extended to the next working day.
To exercise this right, the buyer must:
• Notify their decision by email to contact@tapir-equipements.fr, indicating the order number;
• Return the product via Colissimo Recommandé (registered mail) to: TAPIR Equipements, ZAC du PIDA, Building 17, 38490 AOSTE, France;
• Return the product in its original packaging, in perfect condition, unused, within 14 days of notifying the buyer of their withdrawal.
Only products returned complete, in their original, undamaged packaging, and in perfect condition for resale will be accepted. Any damaged product or product whose packaging is damaged will not be eligible for a refund or exchange.
Refund : TAPIR Equipements will refund the amounts paid, excluding the initial delivery charges, within 14 days of receiving the return, by check, bank transfer, credit card, or PayPal. Return shipping costs remain the responsibility of the buyer, except in cases of error attributable to TAPIR Equipements.
Exchange : In the event of an exchange, the return costs remain the responsibility of the buyer, the reshipment of the new item will be charged to the buyer, unless otherwise provided for in article 18 (Insurance for size error).
Withdrawal form : In accordance with the appendix to Article R.221-1 of the Consumer Code, a standard withdrawal form is available in the appendix to these Terms and Conditions.
Article 12 – Size error
If the customer has selected the wrong size, the return shipping costs are their sole responsibility. The manager may, at their discretion, offer a goodwill gesture towards the reshipping costs.
If the error is attributable to TAPIR Equipements (incorrect manufacturing or delivery), a return label will be emailed to the customer so they can return the products free of charge for exchange. See also Article 18 (Sizing Error Insurance).
Article 13 – Legal and commercial guarantees
Legal guarantee of conformity (art. L. 217-4 & s. of the french consumer code) : Every consumer benefits from a two-year legal guarantee of conformity from the date of delivery for any lack of conformity existing at the time of delivery. This guarantee covers the repair or replacement of the goods, and failing that, a price reduction or the cancellation of the contract.
Warranty against hidden defects (art. 1641 & s. of the french civil code) : The seller is liable for hidden defects in the item sold that render it unfit for its intended use. The buyer must take action within two years of discovering the defect.
TAPIR Equipements Commercial warranty : All products are guaranteed for 2 years against manufacturing defects under normal use. In the event of a defect, the product must be returned via Colissimo Registered Mail to: TAPIR Equipements, ZAC du PIDA, Route du PIDA, Building 17, 38490 AOSTE, France.
Depending on the situation and at the discretion of TAPIR Equipements, this return will result in either repair, the shipment of a new, identical or equivalent product, or a refund.
Article 14 – Limitation de liability
The customer agrees to use the products in accordance with their intended purpose and the instructions provided, without any modifications that could lead to damage or misuse.
In accordance with Articles L.217-4 & s. of the French Consumer Code, this clause does not limit the consumer's legal rights under statutory warranties (conformity, latent defects). TAPIR Equipements cannot be held liable in cases of gross negligence or willful misconduct.
Article 15 – tax-free sales
No tax-free sales are possible directly on the website. Please contact TAPIR Equipements at contact@tapir-equipements.fr to obtain a customized quote.
Article 16 – Shipping to Switzerland
For shipments to Switzerland, please contact us for a tax-free quote. Sales to Switzerland are contingent upon a Swiss billing and delivery address and actual shipment of the order; no in-person collection or delivery within France will be made without tax.
Due to high shipping and customs costs, sales to Switzerland are final and non-refundable. Exchanges and returns are not eligible for free returns. In case of sizing errors, modifications, or cancellations, the buyer is responsible for shipping costs.
Article 17 – French Military post sector (SP)
No sales to a Military Postal Service should be made directly on this website. Any order placed on this site for delivery to a Military Postal Service will be canceled and refunded.
For delivery to a Military Postal Service, please contact TAPIR Equipements by email (contact@tapir-equipements.fr) and provide the following information:
• Items, sizes, colors, and quantities desired;
• Availability of a tax refund;
• Military Postal Service Certificate (MPSC);
• Billing and shipping addresses;
• Preferred payment method.
Terms and conditions applicable to SP sales :
• Sales are final and non-refundable;
• Promotional discounts on the website do not apply;
• Once shipped, TAPIR Equipements cannot be held responsible for delivery problems (loss, theft, damage, delay);
• In the event of a return to sender, the return shipping costs are the responsibility of the buyer, and non-delivery does not entitle the buyer to a refund;
• In the event of a sizing error or modification, an exchange will take place after the buyer returns the item, according to standard procedures.
Article 18 – Overseas and special destinations
If an order is placed with shipping costs for mainland France when the actual destination does not fall within this rate, the order will be cancelled and must be re-placed with the correct destination and shipping costs.
Article 19 – Ordering options
19.1 Priority order
This option allows for priority order processing, without a guaranteed delivery time. The order in which your order is processed depends on the volume of priority orders currently being processed. This option is non-refundable as it does not constitute a delivery time commitment.
19.2 Size error insurance
This option allows you to exchange items for a different size free of charge, valid only for belts and underbelts, within mainland France, and only once per order.
Conditions:
• Contact TAPIR Equipements upon receipt to obtain a return authorization form by email;
• Complete the return form included in the package;
• Items must be unused;
• Maximum return period: 15 days from receipt.
If a further exchange is not covered by this insurance, the customer is responsible for the shipping costs. If, after the exchange, the customer requests a refund, the original shipping costs will be deducted from the refund amount. The insurance is non-refundable if no size exchange was necessary.
Article 20 – Order cancellation by the seller
TAPIR Equipements reserves the right to cancel an order and issue a full refund for the following reasons:
• Product no longer available for manufacture;
• Pricing or promotional error;
• Quantity too large, causing logistical problems (contact us for group orders);
• Customer acting disrespectfully, in bad faith, or attempting to damage the company's reputation.
Article 21 – Consumer mediation
In accordance with Articles L.612-1 et seq. of the Consumer Code, every consumer has the right to use a consumer mediator free of charge for the amicable resolution of a dispute.
In the event of an unresolved dispute with TAPIR Equipements, the consumer may contact the following mediator (remplacer par votre médiateur référent, ex. : le Médiateur du Commerce) :

Article 22 – Applicable law and jurisdiction
These Terms and Conditions are governed exclusively by French law.
In the absence of an amicable settlement, any dispute relating to the interpretation or performance of these Terms and Conditions shall be brought before the Commercial Court of Vienne (38).
For consumers, this jurisdiction clause does not preclude mandatory provisions that grant jurisdiction to the courts of their domicile or the place of performance of the service (Art. R.631-3 of the French Consumer Code).
